Bombay High Court says PF pension cannot be denied due to missing old employer records

A significant development has emerged regarding PF pension as the Bombay High Court ruled that benefits cannot be denied due to missing old employer records.
ఉద్యోగుల ప్రావిడెంట్ ఫండ్ (EPF) పెన్షన్పై బాంబే హైకోర్టు కీలక తీర్పు ఇచ్చింది. కిరణ్ రాజారాం జాధవ్ వర్సెస్ EPFO కేసులో ఈ నిర్ణయం వెలువడింది. సాధారణంగా పీఎఫ్ క్లెయిమ్ లేదా పెన్షన్ ప్రయోజనాల కోసం పాత మరియు ప్రస్తుత కంపెనీల రికార్డులు తప్పనిసరిగా ఉండాలి. అయితే పాత రికార్డులు లేకపోయినా ఆ కారణంతో ఉద్యోగుల హక్కులను నిరాకరించడం సరైంది కాదని కోర్టు పేర్కొంది.
The Bombay High Court delivered an important ruling in the Kiran Rajaram Jadhav vs EPFO case. Typically, PF claims require records from both past and present employers. However, the court clarified that absence of old records cannot be used to deny employee benefits.
కోర్టు పరిశీలనలో, Form 6A వంటి చట్టబద్ధ రికార్డులను నిర్వహించడం యజమానుల బాధ్యత అని స్పష్టం చేసింది. ఉద్యోగులకు ఈ రికార్డులపై నియంత్రణ ఉండదని, అందువల్ల వారి మీద బాధ్యత మోపడం సరికాదని అభిప్రాయపడింది.
The court noted that maintaining statutory records like Form 6A is the employer’s responsibility. Employees do not control these records, and hence cannot be penalized for their absence.
పెన్షన్ క్లెయిమ్ల పరిశీలనలో Form 3A, EPF ఖాతా స్టేట్మెంట్లు, కాంట్రిబ్యూషన్ వివరాలు, జాయింట్ ఆప్షన్ అప్లికేషన్లు, యజమాని ధృవీకరణ వంటి పలు ఆధారాలను పరిగణలోకి తీసుకోవాలని సూచించింది.
The court directed authorities to consider multiple documents such as Form 3A, EPF statements, contribution records, joint option applications, and employer certifications while evaluating claims.
