Telangana High Court Issues Notices on ORR-RRR Radial Road Land Acquisition
హైదరాబాద్ సమీపంలో ఓఆర్ఆర్–ఆర్ఆర్ఆర్ గ్రీన్ఫీల్డ్ రేడియల్ రోడ్డు భూసేకరణపై రైతుల పిటిషన్ను విచారించిన హైకోర్టు ప్రభుత్వం నుంచి వివరణ కోరింది.
The High Court sought a response from the government over farmers’ plea on land acquisition for the ORR–RRR greenfield radial road near Hyderabad.
రంగారెడ్డి జిల్లాలోని యాచారం, కడ్తాల్, ఆమనగల్ మండలాల పరిధిలో ప్రతిపాదించిన ఈ రహదారి నిర్మాణానికి సంబంధించి భూసేకరణ ప్రక్రియలో నిబంధనలు పాటించలేదని రైతులు హైకోర్టును ఆశ్రయించారు. మొత్తం 554.34 ఎకరాల భూమి సేకరణకు జారీ చేసిన నోటిఫికేషన్ను సవాలు చేస్తూ సుమారు 30 మంది రైతులు పిటిషన్ దాఖలు చేశారు.
పిటిషనర్ల తరపు న్యాయవాదులు వాదిస్తూ.. భూసేకరణ, పునరావాస చట్టం-2013లో ఉన్న నిబంధనలు పాటించలేదని, ముఖ్యంగా రైతుల అభ్యంతరాలను సక్రమంగా స్వీకరించలేదని కోర్టుకు తెలిపారు. తమ అభ్యంతరాలను సరైన కారణం లేకుండా తిరస్కరించారని, ఇది చట్టవిరుద్ధమని పేర్కొన్నారు. సుమారు 61 ఎకరాల భూముల నుంచి బలవంతంగా ఖాళీ చేయించే అవకాశం ఉందని రైతులు ఆందోళన వ్యక్తం చేశారు.
ఈ వాదనలపై విచారణ జరిపిన న్యాయమూర్తి జస్టిస్ ఎన్వీ శ్రవణ్ కుమార్ ప్రభుత్వం పూర్తి వివరాలతో కౌంటర్ అఫిడవిట్ దాఖలు చేయాలని ఆదేశించారు. ఈ కేసులో వాస్తవ పరిస్థితులను స్పష్టంగా తెలియజేయాలని సూచించారు.
ప్రభుత్వం తరఫున అడ్వకేట్ జనరల్ వాదనలు వినిపిస్తూ.. మొత్తం భూసేకరణలో కొంతభాగం మాత్రమే వివాదంలో ఉందని, ఇప్పటికే కొన్ని భూములకు పరిహారం ప్రక్రియ ప్రారంభించామని తెలిపారు. రైతులకు పరిహారం చెల్లించే వరకు భూములను స్వాధీనం చేసుకోబోమని కోర్టుకు హామీ ఇచ్చారు.
ఈ హామీని పరిగణనలోకి తీసుకున్న హైకోర్టు తదుపరి విచారణను సెలవుల తర్వాతకు వాయిదా వేసింది. ఈ రహదారి ప్రాజెక్టు ఓఆర్ఆర్ కొంగరకలాన్ నుంచి ఆకుతోటపల్లి వరకు విస్తరించనుంది.
The Telangana High Court has issued notices to the state government over land acquisition for the proposed greenfield radial road connecting ORR and RRR. Farmers from Yacharam, Kadthal, and Amangal mandals in Rangareddy district challenged the acquisition process, alleging violations of the Land Acquisition Act, 2013.
According to the petitioners, authorities failed to properly consider objections raised by farmers and completed the process in a perfunctory manner. Around 554.34 acres were notified for acquisition, with concerns raised over forced eviction from nearly 61 acres of land.
Hearing the petition, Justice NV Shravan Kumar directed the government to file a detailed counter affidavit explaining the process followed. The court sought clarity on compliance with legal provisions.
The Advocate General, representing the state, informed the court that only a portion of the land is under dispute and compensation proceedings have already begun in some areas. He assured that no farmer would be dispossessed until compensation is paid.
Taking note of this assurance, the High Court adjourned the hearing to a later date after vacations. The project aims to connect Kongarakalan on ORR to Akuthotapalli near the proposed RRR corridor.
